What is a demoted tenancy?

Haringey Council usually gives each tenant a secure tenancy. This gives you a number of rights that you will have as long as you keep to the conditions of your tenancy.

The conditions of your secure tenancy include keeping your rent payments up to date and behaving in a way that does not annoy your neighbours.

If you do not keep to the conditions of your secure tenancy or you or your visitors behave anti-socially, we may apply to the court to remove some of your rights as a secure tenant. You will then have what we call a demoted tenancy.

If you continue to break the conditions of your demoted tenancy the courts must allow us to evict you.

How will my tenancy change?

A demoted tenant will lose a number of tenancy rights, including:

  • the right to buy your home;
  • the right to exchange your home;
  • the right to take in a lodger; and
  • the right to sublet part of your home.

What will not change?

Many of the conditions of the demoted tenancy are the same as those of a secure tenancy. This means:

  • Your tenancy will be for the same length of time.
  • All the tenants named in your tenancy agreement will be allowed to live in your home.
  • The date you pay your rent will not change.
  • You must still pay your rent.
  • The amount of rent you must pay will not change because of your tenancy being demoted.
  • You must pay any rent arrears that you owe.
  • You will keep your right to repairs.
  • You must keep to all the conditions of your tenancy.
  • Any rent you pay in advance or any credit to your rent account will be carried over towards your next payment.

How long does a demoted tenancy last?

A demoted tenancy is for 12 months. If we are satisfied with your behaviour during this time you will go back to a secure tenancy.

What can I do to make sure I don't get evicted?

You need to keep to your tenancy conditions and any conditions added to them because of the demoted tenancy.

You must stop the anti-social behaviour that led to the demoted tenancy.

If you owe us any rent, you must pay this and make sure that you pay your rent on time in the future.

Reporting anti-social behaviour

If you have been experiencing any anti-social behaviour where you live then you should report it to Haringey Council's Anti-Social Behaviour Action Team (ASBAT). You can do this by:

  • Phoning the anti-social behaviour line on 0845 671 1177, Monday to Friday 8am-6pm
  • Visiting one of our Customer Services Centres
